This Donor Agreement (the "Agreement") is considered active as of the last updated date  2023-03-20, by and between Blue Iris Farm, a non-profit organization, ("Blue Iris Farm", "we", "us", or "our") and any party choosing to donate, ("Donor", "you", or "your").

 

WHEREAS, Blue Iris Farm is dedicated to providing a safe haven for animals who have been neglected, abused, or abandoned and requires financial support to continue its mission;

 

WHEREAS, Donor desires to support Blue Iris Farm through various donation types;

 

NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

 

Donation Types

Blue Iris Farm gratefully accepts the following types of donations:

 

a. Online Donations: Donors can make one-time or recurring donations through our website associated with Givebutter. By making an online donation, you agree to provide your payment information, including your credit/debit card or other payment method details, and authorize us to process the donation. You represent and warrant that you have the legal right to use the payment method provided.

 

b. In-Kind Donations: Donors can support Blue Iris Farm by providing goods or services. In-kind donations must be pre-approved by Blue Iris Farm. To make an in-kind donation, please visit the Get Involved page on our website to review the nature of the donation and its potential value to our organization.

 

c. Amazon Wishlist Donations: Donors can purchase items from Blue Iris Farm's Amazon Wishlist. These items are sent directly to Blue Iris Farm and help support the daily needs and care of our animals.

 

d. Corporate Sponsorship Donations: Businesses can support Blue Iris Farm through corporate sponsorships. By participating in a corporate sponsorship, your company agrees to contribute financially or in-kind, in exchange for recognition and promotional opportunities. Please visit the Get Involved page on our website to review available sponsorship levels and benefits.

 

Donor Acknowledgment and Tax Deductibility

Blue Iris Farm will provide a receipt for all eligible donations, which donors should retain for their tax records.

 

Use of Donations

Blue Iris Farm will use donations at its discretion for its charitable purposes, including but not limited to providing shelter, food, medical care, and other necessities for the animals in its care, as well as supporting its rescue, advocacy, and educational efforts.

 

Refund Policy

All donations to Blue Iris Farm are non-refundable, except in cases of duplicate transactions or errors made by Blue Iris Farm. If you believe an error has occurred, please contact us at info@blueirisfarm.com within 30 days of the transaction.

 

Liability

Donor acknowledges that Blue Iris Farm is a working farm with animals that may be dangerous, and Donor assumes all risks and dangers associated with visiting Blue Iris Farm. Donor agrees to indemnify and hold Blue Iris Farm, its officers, directors, employees, volunteers, and agents, harmless from any and all claims, damages, liabilities, costs, and expenses arising out of or in connection with Donor's visit to Blue Iris Farm.

 

Term and Termination

This Agreement shall remain in effect permanently for any donations. 

 

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the state of Connecticut, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination, shall be resolved by mediation or arbitration in accordance with the rules of the American Arbitration Association. The mediation or arbitration shall take place in Connecticut and the parties agree to submit to the exclusive jurisdiction of the courts of Connecticut for any legal proceedings related to this Agreement.

 

Entire Agreement

This Agreement contains the entire understanding of the parties and supersedes all prior negotiations, understandings, and agreements between the parties relating to the subject matter hereof. This Agreement may not be modified except in writing signed by both parties if applicable prior to donation.

 

By processing any donation to Blue Iris Farm you have executed this Agreement as of the date of donation no changes or modifications to the agreement will be permitted.
